These Terms and Conditions (“Terms”) govern your access to and use of goda.co, any related GODA websites, applications, customer portals, and services, and your purchase or use of products offered by GODA (“GODA,” “we,” “us,” or “our”).
Please read these Terms carefully. They form a legally binding agreement between you and GODA.
These Terms contain provisions concerning binding individual arbitration, waiver of jury trial, and waiver of class or representative actions that affect your legal rights. Please review the Dispute Resolution section carefully.
By accessing the Site, placing an order, enrolling in a subscription, or otherwise using our Services, you agree to these Terms and any policies incorporated into them by reference. If you do not agree, you should not use the Services.
Our online store is hosted by Shopify Inc., which provides the e-commerce platform through which we offer our products and Services.
1. Eligibility and Use of the Services
You must be legally capable of entering into a binding agreement in your jurisdiction to make purchases through the Services.
If you are not the age of majority in your jurisdiction, you may use the Services only with the involvement and permission of a parent or legal guardian where permitted by law.

We may suspend or terminate access to the Services for conduct that violates these Terms.
2. Orders and Contract Formation
By submitting an order, you are offering to purchase the products identified in your order subject to these Terms.
An electronic order confirmation acknowledges that we received your order but does not necessarily constitute final acceptance.
All orders are subject to:
- Product availability
- Payment authorization
- Fraud and security review
- Verification of order information
- Applicable geographic or other restrictions
GODA reserves the right to accept, decline, limit, or cancel an order where reasonably necessary, including where we suspect fraud, unauthorized payment activity, resale, abuse of promotional offers, pricing errors, or inaccurate customer information.
If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method.
3. Personal Use and Resale Restrictions
Unless otherwise authorized by GODA in writing, products purchased through our consumer website are intended for personal, non-commercial use.
You may not purchase products for unauthorized resale, redistribution, or commercial distribution.
We may cancel orders, limit quantities, restrict accounts, or refuse future service where we reasonably believe products are being purchased for unauthorized resale or where a customer is attempting to manipulate or abuse promotions, discounts, subscription benefits, or other GODA programs.
4. Products, Descriptions and Availability
We make reasonable efforts to accurately describe and display our products.
However, product packaging, appearance, colors, specifications, ingredients, availability, and other characteristics may occasionally differ from images or information displayed on the Site, including because of device displays, product updates, manufacturing changes, or other circumstances.
Products may be offered in limited quantities and may be modified, discontinued, or become unavailable without notice.
We reserve the right to correct errors, inaccuracies, and omissions concerning:
- Product descriptions
- Prices
- Promotions
- Shipping
- Availability
- Subscription offers
- Discounts
- Other information appearing on the Site
If an error materially affects an order you have already submitted, we may contact you, correct the order where permitted, or cancel and refund the affected transaction.
5. Pricing, Currency and Payment
Prices displayed on the Site are subject to change before an order is completed.
The price applicable to your purchase will ordinarily be the price displayed during checkout when your order is submitted, subject to correction of obvious errors where permitted by law.
Prices are generally displayed in U.S. Dollars unless otherwise indicated.
Where GODA provides an estimated display in another currency, your bank, payment provider, or card issuer may apply its own exchange rate, foreign transaction charge, or other fee. GODA is not responsible for fees separately imposed by your financial institution.
Available payment methods are displayed during checkout and may change from time to time.
By providing payment information, you authorize GODA and its payment service providers to charge your selected payment method for amounts associated with your purchase, including applicable:
- Product charges
- Shipping charges
- Taxes
- Subscription renewals that you have authorized
You agree to provide current, complete, and accurate billing and payment information.
We may use third-party payment processors, including payment services provided through Shopify.
6. Taxes, Duties and International Orders
Applicable sales taxes and similar charges may be calculated during checkout based on the information available to us at that time.
For international orders, customs duties, import taxes, brokerage charges, or other governmental or carrier fees may apply depending on the destination.
Unless GODA expressly states during checkout that such charges are included, you are responsible for charges imposed by your local customs authority, government, carrier, or other applicable third party.
GODA does not control these third-party charges.
7. Shipping and Delivery
Orders will be shipped to the delivery address submitted with the order.
Current processing times, shipping methods, delivery estimates, and any applicable shipping charges may be displayed on the Site, on our shipping information pages, or during checkout.
Delivery dates and transit times are estimates rather than guaranteed delivery dates, except where expressly stated otherwise or required by applicable law.
Shipping or delivery may be affected by circumstances including:
- Carrier delays
- Customs processing
- Weather
- Holidays
- High order volumes
- Inventory availability
- Incorrect or incomplete addresses
- Events outside GODA's reasonable control
An order may also be shipped in multiple packages or from more than one fulfillment location.
We may be unable to change a delivery address once an order has entered fulfillment or transit.

8. Returns and 30-Day Money-Back Guarantee
GODA offers a 30-Day Money-Back Guarantee, subject to the terms of our then-current Return Policy.

For products that are damaged, defective, or incorrect, we may request photographs, video, packaging information, or other reasonable evidence to help resolve the issue.
Approved refunds will generally be issued to the original payment method.
After GODA processes a refund, the time required for funds to appear in your account is determined by your bank or payment provider.
Original shipping charges are non-refundable unless otherwise stated in our Return Policy or required by applicable law.
Our current Return Policy, as displayed on goda.co, is incorporated into these Terms.
9. Promotions and Discount Codes
GODA may offer promotional codes, discounts, gifts, introductory prices, bundles, or other special offers.
Unless otherwise stated in the offer:
- Promotional codes have no cash value
- Promotional codes cannot be exchanged for cash
- Offers may not be combined
- Offers may be limited to eligible products or customers
- Offers may expire
- Offers may be limited to one use per customer
- Offers may not apply to previous purchases
- GODA may refuse or cancel an offer in cases of fraud, abuse, circumvention, or pricing error

10. GODA Subscription Program
This Section applies when you affirmatively enroll in an automatically renewing GODA subscription or recurring-shipment program.
Enrollment
Subscription enrollment is optional.
The Site may allow you to choose between a one-time purchase and a subscription purchase.
Before enrolling, the Site will disclose applicable information concerning the subscription, which may include:
- Product
- Price
- Discount
- Billing frequency
- Shipping frequency
- Applicable subscription benefits
By enrolling, you authorize GODA to automatically charge your payment method and create recurring orders according to your selected schedule until you cancel.
Subscription Frequency
Available subscription frequencies may vary by product.
Current GODA options may include recurring delivery approximately every:
28, 30, 45, or 60 days, with certain 90–120 day options available through customer service.
The frequency actually selected and disclosed to you at enrollment controls your subscription.
The existing GODA page currently uses these frequencies and states there are no cancellation fees.
First and Recurring Charges
Your initial purchase is charged when your first order is created.
Subsequent subscription orders will be automatically created and charged according to your selected subscription frequency.
We will provide a reminder before an upcoming renewal charge as described during enrollment or where otherwise required by applicable law.
The reminder may include information such as:
- Upcoming charge amount
- Billing date
- Instructions for skipping
- Instructions for pausing
- Instructions for modifying or cancelling
Managing Your Subscription
You may manage eligible subscription settings, which may include the ability to:
- Skip an upcoming order
- Pause the subscription
- Change eligible products or scents
- Update a shipping address
- Update a payment method
- Change an eligible delivery frequency
- Cancel
You may manage your subscription through the GODA self-service subscription portal or by contacting:
There is no cancellation fee and no required minimum subscription period, unless a particular offer expressly states otherwise before you enroll.
To avoid an upcoming scheduled charge, please submit your cancellation at least 24 hours before your next scheduled billing date.
Email cancellation requests are processed as promptly as reasonably possible. A charge that has already been processed before cancellation is completed may constitute an existing order and may instead be subject to the applicable Return Policy.
Failed Subscription Payments
If a recurring payment does not process successfully, we or our service providers may attempt to:
- Retry the payment
- Contact you
- Ask you to update your payment method
- Delay or cancel the applicable shipment
You remain responsible for authorized orders that have already been fulfilled.
Subscription Pricing Changes
Subscription pricing, discounts, products, benefits, and availability may change from time to time.
Changes will not retroactively change a shipment that has already been charged.
Where required by applicable law, we will provide notice before a change takes effect.
Complimentary Mystery Scent and Other Subscription Gifts
From time to time, eligible subscription orders may include a complimentary product, including a Mystery Scent, gift, promotional item, or other subscription benefit.
The uploaded subscription terms specifically contemplate GODA selecting a Mystery Scent at no additional charge.
Unless GODA expressly states otherwise:
- Complimentary products are selected by GODA
- Particular scents or products are not guaranteed
- Gifts may vary between shipments
- Offers may be changed, substituted, or discontinued
- Availability may be limited
Cancellation or Suspension by GODA
GODA may suspend or terminate a subscription in cases involving:
- Fraud
- Payment failure
- Abuse of promotional pricing
- Multiple-account circumvention
- Resale
- Violation of these Terms
- Conduct harmful to GODA or others
We may also modify or discontinue the Subscription Program, subject to applicable law.
11. Customer Accounts
Where customer accounts are available, you are responsible for safeguarding access to your account.
You agree to provide accurate information and promptly update information where appropriate.
You are responsible for activity occurring through your account to the extent permitted by law.
Please contact us promptly if you believe your account or payment information has been used without authorization.
12. Privacy
Our Privacy Policy explains how GODA collects, uses, discloses, and otherwise processes personal information and describes applicable rights and choices.
By using the Services, you acknowledge that you have been provided access to our Privacy Policy.
13. Intellectual Property
The Site and its contents, including as applicable:
- GODA trademarks
- Brand names
- Logos
- Product names
- Photographs
- Videos
- Designs
- Packaging
- Website layouts
- Graphics
- Written content
- Product descriptions
- Software
- Other creative materials
are owned by or licensed to GODA and are protected by applicable intellectual-property laws.
Except as permitted by law, you may not reproduce, copy, distribute, publish, modify, sell, exploit, or commercially use GODA content without prior written authorization.
Nothing in these Terms grants you ownership of GODA intellectual property.
14. Reviews, Feedback and User Submissions
If you voluntarily submit a review, photograph, testimonial, suggestion, idea, feedback, or similar content to GODA, you represent that you have the legal right to submit that material.
Your submission must not:
- Violate another person's intellectual-property rights
- Violate privacy or publicity rights
- Contain unlawful or defamatory content
- Contain malware
- Misrepresent your identity or experience
To the extent permitted by law, by submitting content for publication or promotional use, you grant GODA a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, adapt, and publish that content in connection with GODA's business and marketing.
We may remove user content that violates these Terms or applicable law.
15. Third-Party Services and Links
The Services may contain links to, integrations with, or functionality provided by third parties.
Third-party services may have separate terms and privacy practices.
GODA does not control those third parties and is not responsible for their independent services, content, security practices, privacy practices, or availability except to the extent required by applicable law.
Your dealings with a third party may be governed by your agreement with that third party.
16. SMS/MMS Mobile Messaging Program
This Section applies if you affirmatively enroll in a GODA SMS/MMS mobile messaging program (“SMS Program”).
GODA currently uses third-party messaging infrastructure, including Klaviyo, in connection with its SMS Program. The current GODA Terms identify Klaviyo in the program's dispute-resolution provisions.
Consent and Opt-In
By affirmatively enrolling, you consent to receive recurring SMS/MMS messages at the telephone number you provide.
Messages may concern:
- GODA products
- Promotions and offers
- New products
- Order information
- Subscription reminders
- Checkout reminders
- Other GODA marketing or transactional communications consistent with your consent
Consent to receive marketing text messages is not a condition of purchasing any goods or services.
Message and data rates may apply.
Message frequency varies.
SMS Opt-Out
You may opt out by replying STOP to a GODA marketing message.
Other recognized opt-out keywords may also be processed where supported by the messaging platform.
You may receive a final message confirming your opt-out.

Emailing customer service is not necessarily an immediate substitute for using the SMS opt-out keyword where an automated opt-out is available.
Telephone Number Changes
If you relinquish a telephone number used to enroll in the SMS Program, you should opt out before discontinuing use of that number so messages are not sent to a later holder of the number.
SMS Availability
SMS and MMS services depend on mobile carriers and telecommunications providers.
GODA does not guarantee that every message will be delivered or received, and carriers are not responsible for delayed or undelivered messages.
SMS Age Requirements
You may not enroll in the SMS Program if you are under 13.
If you are between 13 and 18 or otherwise below the applicable age of majority in your jurisdiction, you must have permission from a parent or legal guardian where required by law.
SMS Program Disputes
Disputes relating specifically to participation in the SMS Program, including claims involving GODA or a messaging provider acting on GODA's behalf, are subject to the arbitration and individual-action requirements described in the SMS Program terms and the Dispute Resolution provisions below to the fullest extent permitted by applicable law.
Nothing in this section eliminates a right that cannot lawfully be waived.
17. Prohibited Uses
You may not use the Site or Services to:
- Commit or facilitate unlawful activity
- Violate laws or regulations
- Infringe copyrights, trademarks, privacy rights, or other rights
- Harass, threaten, stalk, or abuse others
- Discriminate unlawfully
- Submit intentionally false or misleading information
- Transmit malicious software
- Obtain unauthorized access to systems or information
- Harvest personal information
- Spam, phish, pharm, scrape, or otherwise misuse the Services
- Interfere with security or technical functionality
- Circumvent purchase, subscription, pricing, or promotional restrictions
We may suspend or terminate access for violations.
18. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE, SERVICES, AND PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS EXCEPT FOR WARRANTIES OR GUARANTEES EXPRESSLY PROVIDED BY GODA OR REQUIRED BY LAW.
TO THE FULLEST EXTENT PERMITTED BY LAW, GODA DISCLAIMS WARRANTIES THAT MAY OTHERWISE ARISE BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Site will always be uninterrupted
- The Site will always be error-free
- All information will always be current
- Electronic communications will always be secure
- Third-party services will always remain available
Nothing in these Terms excludes warranties, guarantees, or statutory rights that cannot legally be excluded.
19. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GODA AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS.
This may include, where legally permissible:
- Lost profits
- Lost revenue
- Lost data
- Lost opportunities
- Business interruption
- Similar consequential losses
To the fullest extent permitted by applicable law, GODA's aggregate liability arising from a particular product order will not exceed the amount you paid GODA for the order giving rise to the claim.
These limitations do not apply to liability that cannot legally be limited or excluded.
Some jurisdictions do not permit certain warranty disclaimers or limitations of liability. In those jurisdictions, these provisions apply only to the maximum extent permitted by law.
20. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless GODA, its affiliates, officers, directors, employees, and agents from third-party claims arising from:
- Your unlawful use of the Services
- Your material violation of these Terms
- Your infringement of another person's rights
- Content you submit in violation of these Terms
This provision does not require you to indemnify GODA for GODA's own unlawful conduct where such indemnification is prohibited by law.
21. Dispute Resolution; Binding Individual Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO HAVE CERTAIN DISPUTES DECIDED BY A COURT OR JURY.
The uploaded GODA draft introduces a company-wide individual arbitration agreement rather than limiting arbitration solely to SMS disputes.
Informal Resolution First
Before initiating arbitration, the party asserting a dispute must provide the other party with written notice describing:

The parties will attempt in good faith to resolve the dispute informally for 60 days after receipt of the notice before either party initiates arbitration.

Binding Individual Arbitration
Except for disputes that legally cannot be arbitrated and requests for qualifying emergency equitable relief, disputes arising out of or relating to:
- These Terms
- The Site
- Products purchased from GODA
- GODA subscriptions
- Your relationship with GODA
that cannot be resolved through the informal procedure above will be resolved through binding individual arbitration administered by the American Arbitration Association (“AAA”).
The arbitration will be conducted before a single neutral arbitrator in accordance with the applicable AAA rules.
If AAA is unavailable, the parties will select another mutually acceptable arbitration provider.
Any hearing will be conducted in a manner and location consistent with applicable consumer arbitration rules and applicable law.
The arbitrator may award any individual remedy or relief that would otherwise be available under applicable law and that falls within the arbitrator's authority.
A court with appropriate jurisdiction may enter judgment on the arbitration award.
Jury Trial Waiver
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND GODA WAIVE THE RIGHT TO HAVE A DISPUTE SUBJECT TO THIS ARBITRATION AGREEMENT TRIED BEFORE A JUDGE OR JURY.
Class and Representative Action Waiver
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DISPUTES MUST BE BROUGHT INDIVIDUALLY.
Neither party may bring or participate in a claim:
- As a plaintiff or member of a purported class action
- As part of a consolidated arbitration involving unrelated customers
- In a representative capacity on behalf of other customers
unless applicable law makes such a waiver unenforceable.
The uploaded draft expressly requires individual rather than class or consolidated proceedings.
Small Claims and Non-Arbitrable Claims
Nothing in this section prevents either party from bringing an individual matter in small-claims court where the claim qualifies and remains on an individual basis.
Where applicable law prohibits arbitration of a particular claim, that claim may proceed before a court with proper jurisdiction.
Emergency Relief
Either party may seek temporary or emergency equitable relief from a court where reasonably necessary to preserve the status quo or prevent immediate harm pending arbitration.
Arbitration Fees
Arbitration fees and costs will be allocated in accordance with the applicable AAA rules and applicable law.
Each party will otherwise bear its own legal expenses except where applicable law, the AAA rules, or an arbitrator's award permits recovery of attorneys' fees or other expenses.
Severability
If a portion of this arbitration agreement is held invalid or unenforceable, the remaining portions will continue in effect to the extent permitted by law, unless doing so would materially defeat the purpose of this arbitration agreement.
Survival
This Dispute Resolution section survives termination of these Terms and your relationship with GODA.
22. Governing Law
These Terms and your relationship with GODA are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles, except to the extent federal law or another mandatory law applies.
Your existing live GODA Terms already designate Wyoming law.
The Federal Arbitration Act governs the interpretation and enforcement of the arbitration agreement where applicable.
For claims that are not subject to arbitration and are not properly brought in small-claims court, the parties consent, to the extent legally permissible, to the jurisdiction of the appropriate state or federal courts having jurisdiction over Casper, Wyoming.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
23. Termination
You may stop using the Services at any time.
GODA may suspend or terminate access to the Services where you violate these Terms, fail to pay authorized amounts, engage in fraud or abuse, threaten the security of the Services, or otherwise engage in conduct for which suspension or termination is reasonably appropriate.
Termination does not affect rights or obligations that arose before termination.
Provisions that by their nature should survive termination will remain in effect, including provisions concerning:
- Intellectual property
- Payment obligations
- Warranty disclaimers
- Limitations of liability
- Indemnification
- Dispute resolution
- Governing law
24. Changes to the Services
We may modify, suspend, discontinue, or replace features, products, programs, or portions of the Services from time to time.
Products and pricing may also change.
Nothing in this provision affects existing contractual or statutory rights that cannot lawfully be altered.
25. Changes to These Terms
We may update these Terms from time to time.
The Last Updated date at the top identifies when the Terms were most recently revised.
The version in effect when you place an order generally applies to that order unless applicable law or the terms of a particular program provide otherwise.
For ongoing programs such as subscriptions, we may provide additional notice of material changes where required by law.
Your continued use of the Services after updated Terms become effective constitutes acceptance of those updated Terms to the extent permitted by law.
26. Entire Agreement
These Terms, together with policies and terms expressly incorporated by reference, constitute the agreement between you and GODA concerning the applicable Services and supersede prior agreements concerning the same subject matter.
If a provision of these Terms is held invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will continue in effect.
GODA's failure to enforce a provision does not waive its right to enforce that provision later.
27. English-Language Version
Translations of these Terms may be made available for convenience.
Unless prohibited by applicable law, the English-language version controls if there is a conflict or inconsistency between the English version and a translated version.
